Terms of Use

These terms are subject to rights and protections that cannot lawfully be excluded, restricted or modified under applicable Australian law.

1. Acceptance

By accessing or using Averie, creating an account, accepting an invitation, publishing an event website, purchasing an Averie product or using any marketplace or business feature, you agree to these Terms of Use.

2. The Averie service

Averie provides event-planning software, event websites, guest and RSVP management, collaboration tools, marketplace discovery, enquiries, opportunities, proposals and business-management features. Features available to you depend on your account and plan.

3. Accounts

You must provide accurate information and keep it reasonably current. You are responsible for activity undertaken through your account and for maintaining the confidentiality of your credentials. You must notify Averie promptly if you believe your account has been compromised.

4. Eligibility

Averie does not impose a general minimum age. You may use Averie only where you have legal capacity to do so or with any consent or supervision required by applicable law.

5. Acceptable use

You must not use Averie to break the law, infringe another person's rights, upload malicious code, interfere with the service, scrape information unlawfully, impersonate another person, create fraudulent marketplace activity, submit fake reviews or bookings, manipulate rankings, misuse personal information, or otherwise abuse the service.

6. Third-party businesses

Businesses, venues, planners and other marketplace participants are independent third parties. Their services, qualifications, licences, insurance, pricing, availability and performance are their responsibility.

7. Bookings and payments

Averie may facilitate discovery, enquiries, proposals and booking-related workflows. Averie does not currently collect, hold or settle supplier payments. Unless Averie expressly states otherwise, the organiser contracts and pays the supplier directly. Averie is not the supplier and is not a party to that supplier contract.

8. Event websites

Organisers may configure event websites as public, private, password-protected or invitation-only. Organisers are responsible for selecting appropriate visibility and for the information they publish.

9. Availability

Averie aims to provide a reliable service but does not guarantee uninterrupted or error-free operation. Maintenance, security events, third-party outages and circumstances outside Averie's reasonable control may affect availability.

10. Suspension and termination

Averie may suspend or terminate access where reasonably necessary to address fraud, abuse, unlawful conduct, security threats, serious breaches, intellectual property infringement, marketplace manipulation or risks to Averie or other users. Where appropriate, Averie will provide notice and an opportunity to remedy a remediable breach.

11. Consumer rights

Nothing in these Terms limits rights or remedies available under the Australian Consumer Law or any other mandatory law.

12. Governing law

These Terms are governed by Queensland law and applicable Commonwealth laws of Australia. Mandatory rights available under other applicable laws are not displaced.
